For families in counties like Napa or Solano, where property values are often high, the stakes are even greater. Properties in the Bay Area frequently exceed one million dollars, which translates to significantly higher probate fees and bigger risks if the family disagrees on what to do. I’ve seen firsthand how probate can tie up a home for years, leaving adult children scrambling to cover expenses or fighting preventable legal battles.
Three Common Mistakes to Avoid
In my experience as a senior transition specialist, I see the same three pitfalls repeatedly:
Relying Solely on a Will
If your parents own property, a will doesn't stop it from going to probate. Only a living trust can keep the home and your sanity out of court.
Forgetting to Update the Title
Many seniors forget to update the title on their homes. If the deed is only in their name when they pass, the court steps in—even if the family is in total agreement about what should happen.
Lack of Communication
When families don’t discuss their wishes ahead of time, the home can become a "war zone" for siblings.
Planning for the Transition to Senior Living
Transitioning a parent to senior living involves more than just picking a facility. It often requires downsizing a lifetime of belongings and selling the family home to pay for specialized care, such as memory care.
In one instance in Alameda County, a family couldn't sell their mother’s home to pay for their father’s care because the property was tied up in probate. Conversely, a family I worked with in Contra Costa County did the pre-planning—getting a trust in place and prepping the home early. We were able to list their home just weeks after their father passed with zero court delays and multiple offers above the asking price.
